Defect report or expert witness report?

Two reports for two jobs. Which one you need depends on where your dispute is heading.

Wyndham Vale 3024 · 2026-09-09

In short: A defect report starts the conversation with the builder. An expert witness report is for the tribunal.

The defect report

Written for you and the builder. It describes each defect, the standard it fails and what needs fixing.

The dispute path

In Victoria a dispute goes from a written request to the builder, to the Building and Plumbing Commission dispute resolution service (formerly DBDRV), then to VCAT.

The expert witness report

For VCAT, evidence must be prepared to the VCAT practice note for expert witnesses, with the expert's duty to the tribunal set out.

Moving from one to the other

A defect report can be the starting point. If the matter escalates, we can prepare an expert witness report separately.
